Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Detention
A court has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.
In her decision, the judge pointed out that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The court proceedings involve disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in Tennessee.
